Cant beleive it, im shocked.. basically im going down my usual country road at about 40mph (60mph limit) notice that on a slight corner there a dustcart parked up taking up the other side of road, so i slow down to around 30mph and as i approach the front cab the car behind it decides to try and kain it towards me and make it!!! WTF!!! slamed brakes on... road was muddy and wet no chance .. slid towards her tried to plant my car into the verge but it was too steap and muddy and i just slid all over the place bang.. impact into the side of her (as she tried to dive left and hit the dustcart) .. had wheels locked over so my alloy took most of the damage.. it chopped thrue her rear tyre and thrue her steel rim quite nicly.
Damage to body looks like only bumper and wing, but i drove it back after police interview etc. and i had the steering wheel locked over in order to drive in a straight line... so theres going to be some nice damage on suspsension / steering rack / pas system possibly nackered as it was hissing .. ahrrrr
if she was on your side of the road and especially as you appear to have taken avoiding action to your near side then i would say she do'nt have a preverbial leg to stand on.
Take care though would'nt want you to start experienceing flash backs or pain in the wrist's, phycological trauma, nervousness when driving again, e.t.c e.t.c might want to see a doctor so things can be put down on paper for future reference

thanks, i have contacted my insurence company and passed over the details , their soliciters will now contact her / insurence company etc.. and ill hear back within 5 days.. in the mean time im car'less because its undecided and curtosy car is not available untill its been sorted
well i do have witnesses from the dustcart, names and addys i did pass this to the cops / insurence company etc.
I have been out looking at the car.. the wheel that took the hit has been pushed back and is touching the mud gard , the suspension has gone down loads of drivers side so the car looks like it has hydrolics ..
Thats Awful!!! Well Gutted Thought your car looked sweet at millway. She hasn't got a leg to stand on if everything is as you described. I take it the dustcart chaps are on your side??? What did she say at the scene?? did she deny or admit anything?? Its worth making a note of anyhting that was said at the scene. Good luck

I'd just whip off anything that isnt standard - certainly the alloys... I really feel your pain mate, my car was written off a month ago - at least the woman in your case didnt drive off! ... point is, it could have been a lot lot worst - Car is a car, your health is more important etc etc... but its such a shame netherless - to see a coupe like that bashed up I hope its repairable!
Where abouts was this, from northampton me self, know all the rd's quite well, better make sure i don't go flying aroud the same bend in the rust bucket.

Put the car back to complete standard or they will try to worm their way out of paying. They'll say although it was her fault your car isn't to manufacturers spec so your insurance is void.
They could report you to the police for driving without valid insurance, I don't know.

If he doesn't swap the alloys back he may not get anything repaired. Without meaning to sound slack it's his own fault for not declaring them. My old car (Pug 306) had £600 17's on. NUD upped my premium by £30 to cover the wheels in any event and my ICE up to £500. I thought this was very reasonable.
The alloy can be fixed by a smart repairer for £50 tops

If my insurence company was going to pay for my damage then yes i understand they would quibble over the mods.
That's a good point. However, they will note down any mods and may check with your ins comp. For the time it takes to change the bits u'd be better to standardise it

If your modifications are not declared, then technically you weren't insured. Technically, you should not have been on the road in the first place. They will use this line of argument to justify repairing her car and not yours - on the basis it "shouldn't" have been on the road in the first place as it was "uninsured".
Your motor is going ot be an expensive repair job as although it looks like a wing job cosmetically the subframe/chassis structure is f**ked on that side, which ain't an easy repair. Hers probably won't be cheap either, so its worth the insurer's time and money ringing yours to see if you were covered and if they cna escape paying you that way.
Go hire a courtesy car or take taxis everywhere - you are entitled to do this then claim for expenses incurred due to the woman's actions as far as insurance goes.
